Taped over my only bootleg of Once Upon a Time in the West, who's right?

This was about 3 years ago in my buddy's basement in Pittsburgh. I had a VHS of a late night TV rip, the real grainy kind with a cable logo burned in the corner. My friend grabbed it to record a Steelers game without asking, and I lost the whole thing. He says it's my fault for not labeling the tape, but I say you never touch someone's bootleg stash without checking twice. I mean, that cut had the extra scenes and a weird audio track where the music lagged a beat, impossible to find now. He offered me $20 to make up for it, but that's not the point, right? We still argue about it every time we see each other. Would you side with the guy who tapes over a stranger's find, or the guy who left it on the shelf for years? Anyone else had a prized rip destroyed by a friend's carelessness, and how did you settle it?
